Terms of Service

1. Who we are
idaserver.net is operated by IDA LIMITED, a limited liability company registered in Malta ("we", "us", "IDA"). These terms govern every service you order from us: domain names, hosting, reseller packages, cloud VPS and VDS, dedicated servers, and any add-on sold alongside them.
By placing an order you accept these terms. If you order on behalf of an organisation, you confirm that you are authorised to bind it.
2. Your account
- You must give accurate registration details and keep them current. Domain registries and payment providers rely on this data, and inaccurate details can cause a domain to be suspended by the registry.
- You are responsible for everything done through your account, including by people you give access to.
- Keep your credentials confidential. Tell us immediately if you believe your account has been compromised.
- We may refuse or close an account where the details are demonstrably false, where payment is fraudulent, or where the account is used to breach section 8.
3. Orders, prices and renewals
- Prices are published on the website before you order, in EUR or USD, and are the prices charged at renewal unless we notify you of a change in advance.
- Services are billed in advance for the cycle you choose (monthly, annual or longer) and renew automatically until you cancel them in the client area.
- An invoice is issued before each renewal. If it is not paid by the due date the service may be suspended and, after a further period, terminated with the data removed.
- Cancel a service from the client area before the renewal invoice is generated to stop it renewing.
- Where tax applies to your order it is shown separately on the invoice.
4. Refunds
We publish a 30-day money-back period. It works as follows.
Covered
- First purchase of a shared hosting, reseller hosting, cloud VPS or cloud VDS plan: if you tell us within 30 days of the order that you want to stop, we refund the service fee for that plan.
Not covered
- Domain names — registration, transfer and renewal fees are paid to the registry and cannot be recovered once the operation completes.
- SSL certificates once issued.
- Dedicated servers, because the hardware is allocated to you exclusively.
- Software licences (idaFX, idaGaming) and any bespoke work, which are governed by their own agreement.
- Renewals and second or later cycles of the same service, and any amount consumed as account credit.
Refunds are made to the original payment method where the provider supports it; otherwise as account credit. Where an order was paid in cryptocurrency, the refund is issued in the same currency at the rate applying when the refund is processed, and network fees are deducted.
We do not refund services terminated by us for a breach of section 8.
5. Domain names
- Domain registrations are made through accredited registrars and are subject to the rules of the relevant registry and, for gTLDs, to ICANN policy. Those rules override anything in this section that conflicts with them.
- A registration is only complete when the registry confirms it. Until then, the name is not yours and we may have to refund and cancel the order.
- Renewal is your responsibility. We send reminders before expiry, but if a domain expires it may enter a redemption period with a registry fee, and after that it may be released to the public.
- Transfers require the domain to be unlocked and an authorisation (EPP) code to be supplied. Registries block transfers within 60 days of a registration or a previous transfer.
- You must keep registrant contact details accurate. Registries can suspend a domain when a verification message is not answered.
- WHOIS privacy, where offered for an extension, hides contact data from public lookups but not from the registry or from lawful requests.
6. Hosting services
- Plan resources — storage, traffic, CPU, memory, accounts — are published on the plan and are what the server actually carries. We do not oversell capacity.
- Shared and reseller hosting is a shared environment. Processes that degrade the service for other accounts may be throttled or stopped. This includes sustained high CPU use, unattended crawlers, media conversion at scale, and cryptocurrency mining, which is not permitted on shared plans at all.
- Resource limits apply per account. If you consistently exceed them, we will ask you to move to a VPS, VDS or dedicated server.
- Where a plan describes a resource as unlimited, this means we do not meter it — not that a single account may consume the whole machine. Fair use in this section still applies.
7. Servers
- Cloud VPS, VDS and dedicated servers are supplied unmanaged unless a management add-on is purchased. You hold root or Administrator access and you are responsible for the operating system, the software you install, its updates and its security.
- We do not install monitoring agents or keep a management account on your server. That also means we cannot recover data from it for you.
- You are responsible for the lawfulness of everything the server does, including traffic it originates.
- Reinstalling a server erases it completely. Take your own copy first.
- Additional IP addresses are assigned subject to justification and to the policies of the network provider, and remain ours.
8. Acceptable use
You may not use our services to host, transmit or facilitate:
- Content that is unlawful under Maltese or European Union law, or under the law of the place you operate from.
- Child sexual abuse material — accounts are terminated immediately and reported.
- Phishing, malware, botnet command and control, credential harvesting, or the sale of stolen data.
- Unsolicited bulk e-mail, open relays, or lists you cannot show consent for. Sending spam from our network is grounds for immediate suspension.
- Material that infringes someone else's copyright, trade mark or other rights.
- Attacks on any network or system, including port scanning, brute forcing and denial-of-service traffic.
- Deliberate circumvention of resource limits, or reselling shared hosting resources outside a reseller plan.
Where a service is used for gambling, financial services, adult content or any other regulated activity, holding the required licence is your responsibility, not ours.
9. Suspension and termination
- We may suspend a service without notice where it is being used in breach of section 8, where it threatens the stability or security of our network, or where we are required to by law or by a registry.
- For non-payment we suspend after the due date and terminate after a further period, at which point data may be deleted and cannot be recovered.
- Where suspension is not urgent, we tell you what the problem is and give you a reasonable chance to fix it.
- You may terminate any service at any time from the client area. Termination takes effect at the end of the paid cycle unless section 4 applies.
10. Support
- Support is provided through the ticket system in the client area. We do not operate a telephone support line. Everything is handled in writing so the history stays attached to your account.
- Support covers our platform: provisioning, network, the control panels we supply, and billing. It does not cover application development, custom code, or the administration of an unmanaged server, although we will help where we reasonably can.
- We aim to answer quickly, and urgent platform issues are prioritised, but we do not commit to a specific response time unless a support or management add-on is purchased that says otherwise.
11. Availability and maintenance
- We work to keep services available continuously, but we do not publish a guaranteed uptime percentage and no service credit scheme applies unless it is agreed separately in writing.
- Planned maintenance is announced in advance in the client area where it will interrupt service. Emergency work needed to protect the platform may be carried out without notice.
- Interruptions caused by matters outside our control — network operators, registries, upstream providers, denial-of-service attacks, or events of force majeure — are not our responsibility.
12. Software licences
idaFX and idaGaming are software products we develop and license. They are supplied under a separate licence agreement that sets out scope, deployment, support and fees. Nothing in these terms transfers ownership of our software, and a licence does not include the source code unless the agreement says so.
You are responsible for holding whatever licences or authorisations your own business requires in order to operate software we license to you.
13. Your content and backups
- Your data stays yours. We only access it where it is needed to run or fix the service, where you ask us to, or where the law requires it.
- Backups are your responsibility. Where a plan includes a backup feature, treat it as a convenience and not as your only copy. We do not guarantee that any backup can be restored.
- After a service is terminated the data is removed and cannot be recovered.
14. Liability
- We provide the services with reasonable skill and care. To the extent the law allows, we exclude implied warranties.
- We are not liable for lost profit, lost revenue, lost or corrupted data, or indirect or consequential loss.
- Where we are liable, our total liability for all claims in any twelve-month period is limited to the amount you paid us for the affected service in that period.
- Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
- If you are a consumer, your statutory rights are unaffected.
15. Data protection
We process personal data as described in our Privacy Policy, which forms part of these terms.
16. Changes to these terms
We may update these terms. Material changes are announced in the client area at least 30 days before they take effect. Continuing to use the services after that date means you accept the new version. If you do not, you may terminate and we will refund any unused prepaid period.
17. Governing law
These terms are governed by the laws of Malta, and the courts of Malta have jurisdiction. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory rules of your own country.

Services are billed in advance for the cycle you choose and renew automatically until you cancel them from the client area. Prices shown on this site are the prices charged at renewal. The full terms are published on our terms and conditions page.
Orders are activated once payment is confirmed and the order clears our standard fraud and identity checks. Domain registrations go live as soon as the registry acknowledges the request, hosting and reseller accounts are provisioned automatically with the credentials sent to the email address on file, and cloud VPS instances are built from the image selected at checkout. Dedicated servers and any order flagged for manual review are handled by our provisioning team, who will reach you through a support ticket if further documentation is required.
Refund requests are handled by our billing team against the Terms of Service accepted at checkout. Open a ticket from your client area with the invoice number and the reason for the request, and the outcome is confirmed in writing on the same ticket.

VPS, cloud VPS, cloud servers, dedicated servers and infrastructure services are billed for capacity allocated to you at the moment of provisioning, so requests on those products are assessed individually. Licences for idaFX and idaGaming follow the terms of the licence agreement signed for each deployment.
Where the Terms of Service or Acceptable Use Policy agreed at ordering have been breached, IDA LIMITED reserves the right to decline a refund, and the same applies where we determine that a service has been abused.
